
Statute of Limitations for the State of Alabama
Statute of Limitations for Personal Injury – 2 years from the date of injury
Date of injury – the ‘last exposure’ by the plaintiff begins statute of limitations
Discovery Rule – cause of action accrues “only where there has occurred a manifest, present injury”
Manifest – observable signs or symptoms or the existence of which is medically identifiable.
Statute of Repose – 20 years from first ‘right to sue’
Wrongful Death – 2 years from the date of the decedents death
